Terms of Service

1. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

2. The service

Pamosnik lets you connect an Instagram Business account and/or a WhatsApp Business number and configure automations that send and receive messages and reply to comments on your behalf. On the plans that include it, our AI assistant (Eva) drafts and sends those replies for you; it can make mistakes, so you remain responsible for reviewing the automations you enable. We may add, change, or remove features over time. We do not guarantee uninterrupted or error-free operation.

3. Acceptable use

You agree not to use Pamosnik to:

• send spam, unsolicited, deceptive, or unlawful messages;
• violate the Meta Platform Terms, the Instagram Community Guidelines, the WhatsApp Business Messaging Policy, or any applicable law or regulation;
• infringe the rights of others or harvest data without consent;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the service.

You are solely responsible for the content of the messages and automations you create and for obtaining any consents required to message your audience.

4. Third-party platforms

The service depends on the Meta APIs (Instagram and the WhatsApp Business Platform) and, on the AI plans, on third-party AI model providers. Your use of those platforms is subject to their own terms, and they may change or restrict API access at any time. We are not responsible for actions taken by them, including suspension of your Instagram account or WhatsApp Business number.

5. Fees

Some plans are paid. Fees, billing cycles, and any free tier are described at sign-up or on our pricing page. Unless stated otherwise, fees are non-refundable. We may change pricing with reasonable notice.

6. Intellectual property

Pamosnik and its software are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service. You retain ownership of the content and data you provide.

7. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that risks harm to others or to the platform. On termination, your data is handled as described in our Privacy Policy and Data Deletion Policy.

8. Disclaimers and liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Pamosnik is not liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the service.

9. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the effective date. Continued use after changes means you accept the updated Terms.
